LEGAL SEPARATION

A Legal Separation won't dissolve your marriage in the eyes of the court, but there are still advantages for obtaining a Judgment of Legal Separation. A Legal Separation allows your attorney to begin the process of marital property division, address child custody and child support, and spousal support. In a nut shell, the only difference between a Legal Separation and Dissolution of Marriage (Divorce) is that when all is said and done you are still married at the end of a Legal Separation. You will need to file divorce afterward, if that is what you want.

Besides the obvious reason to not divorce due to some belief that the marriage can be salvaged, there are other more practical reasons to obtain a Legal Separation. Legal Separation can be used to preserve the relationship while maintaining assets and rights while seeking protection from creditors or obtaining certain governments benefits. Some benefits of legal separation are:

  • You may retain certain benefits of a married couple, generally including health insurance benefits.

  • You may get certain government benefits that you may not be eligible for if married and not separated.

  • You can protect your rights in all matters relating to alimony, child custody and child support.

  • You may protect yourself from debt incurred by your spouse.

  • The final terms of your Legal Separation may include specific items relating to mortgage payments, home maintenance and use.
